Neorelic Design Solutions Terms and Conditions of Use
1. Terms
By accessing this web site, you are agreeing to be bound by these
web site Terms and Conditions of Use, all applicable laws and regulations,
and agree that you are responsible for compliance with any applicable local
laws. If you do not agree with any of these terms, you are prohibited from
using or accessing this site. The materials contained in this web site are
protected by applicable copyright and trade mark law.
2. Use License

Permission is granted to temporarily download one copy of the materials
(information or software) on Neorelic Design Solutions' web site for personal,
non-commercial transitory viewing only. This is the grant of a license,
not a transfer of title, and under this license you may not:

modify or copy the materials;

use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

attempt to decompile or reverse engineer any software contained on Neorelic Design Solutions' web site;

remove any copyright or other proprietary notations from the materials; or

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Neorelic Design Solutions at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
3. Copyright and Ownership

Upon completion of a project, it is Neorelic Design Solutions' policy to transfer full copyright ownership of the design to the client. However, Neorelic Design Solutions retains the right to:

use an image of the client's design in any future promotional material;

display an image of the client's design in its portfolio, both online and in printed reproductions.

Upon finalisation of a project, only the accepted concept design becomes the property of the client. Concept designs not accepted by the client remain the exclusive property of Neorelic Design Solutions who may use such designs for any future purpose.

Should the client request a refund, their acceptance of the refund indicates that any designs created for the client prior to that request remain the exclusive property of Neorelic Design Solutions, whom will retain full copyright ownership.

To the best of Neorelic Design Solutions' knowledge, all designs produced by the studio are wholly original in nature. Should it be deemed, by coincidence, that a similar design already exists, modifications to the design will be made free of charge for the client.

Should images be submitted by the client to Neorelic Design solutions, it will be assumed that the client is the copyright holder of that image or has obtained the appropriate permissions for the use of that image. Neorelic Design Solutions accepts no responsibility for copyright or trademark infringement from the use of said image.
4. Project Duration

Upon placing an order with Neorelic Design Solutions, the client agrees to provide timely responses to any status notifications sent via email or by other means. The client shall have 28 days to respond to each notification. If after 28 days the client has failed to respond, Neorelic Design Solutions will assume that the project is considered complete and the client's eligibility for a refund will be at Neorelic Design Solutions' sole discretion.

Neorelic Design Solutions' expected turnaround time for each revision is two business days. Neorelic Design Solutions should at no time be expected to complete revisions or respond to emails during non-business days (i.e. Saturday, Sunday) and national (Australian) or state (New South Wales) public holidays.

Due to unpredictable order volumes or circumstances beyond Neorelic Design Solutions' control, advertised turnaround times cannot be guaranteed.

Neorelic Design Solutions reserves the right to refuse service to any client. In such a case, the full order amount will be refunded and the client will be notified. The reason for refusal of service need not be disclosed.

Neorelic Design Solutions provides unlimited concept revisions at no extra charge until client expectations have been met. Once a design has been chosen and the project finalised, any future revisions will incur additional charges.
5. Refunds

A refund can be issued only if the client is dissatisfied with their entire first batch of concept designs. In order to receive a refund the client must:

be able to provide an invoice and/or order number;

lodge a request via email within 28 days of the initial order. The request for a refund must be made using the same email address that was used to place the initial order.

If a client chooses to proceed with the revision process for their preferred logo/business card concept from the initial batch of concepts, a refund can no longer be provided.
6. Disclaimer

The materials on Neorelic Design Solutions' web site are provided "as is." Neorelic Design Solutions makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Neorelic Design Solutions does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.
7. Limitations
In no event shall Neorelic Design Solutions or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Neorelic Design Solutions' Internet site, even if Neorelic Design Solutions or a Neorelic Design Solutions authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
8. Revisions and Errata
The materials appearing on Neorelic Design Solutions' web site could include technical, typographical, or photographic errors. Neorelic Design Solutions does not warrant that any of the materials on its web site are accurate, complete, or current. Neorelic Design Solutions may make changes to the materials contained on its web site at any time without notice. Neorelic Design Solutions does not, however, make any commitment to update the materials.
9. Links
Neorelic Design Solutions has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Neorelic Design Solutions of the site. Use of any such linked web site is at the user's own risk.
10. Governing Law
Any claim relating to Neorelic Design Solutions' web site shall be governed by the laws of the State of New South Wales, Australia without regard to its conflict of law provisions.
11. Site Terms of Use Modifications
Neorelic Design Solutions may revise these Terms and Conditions of Use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.
